1. Definitions
DuzMarc: the service for DMARC, SPF and DKIM monitoring, consisting of the marketing website (duzmarc.nl) and the web application (app.duzmarc.nl). Provider: Düzgün IT Services, the party supplying DuzMarc. Customer: the organisation that creates an account and takes out a subscription. Account: access to the web application in the customer's name. User: a natural person who has access to the account on behalf of the customer, as an administrator or as a member.
2. Applicability
These terms apply to every offer, quotation and agreement between the provider and the customer concerning DuzMarc. Deviations are only valid if agreed in writing. The customer's own purchasing or other conditions are expressly rejected.
3. Formation of the agreement
The agreement comes into being at the moment the customer creates an account at app.duzmarc.nl, chooses a subscription and agrees to these terms, the privacy policy and the data processing agreement. The customer warrants the accuracy of the details provided at registration, including a valid work email address.
4. Trial period
Every subscription starts with a free 30-day trial period. During the trial the customer can stop at no cost and without notice, and no payment method is required. If the customer has set up a SEPA direct debit mandate before the trial ends, the chosen subscription continues automatically afterwards and the subscription fee is collected monthly from then on. If no mandate has been set up, access to the account is suspended after the trial period until the customer either sets one up or cancels the subscription.
5. Subscriptions, changes and cancellation
DuzMarc offers the Starter, Pro, Business and Enterprise subscriptions described on the pricing page. All subscriptions can be cancelled monthly, with no further notice period or long-running contract. An upgrade or downgrade takes effect immediately; nothing is settled pro rata. The amount of the next direct debit is based on the new subscription. Cancellation is possible through the settings page in the account or by email.
6. Prices and payment
All prices on duzmarc.nl are in euros and exclude VAT. Payment is made by SEPA direct debit, processed by our payment service provider Mollie. Invoices, including VAT and billing address, are ready to download in the dashboard under Settings > Subscription; the customer receives a notification about this by email. If a direct debit fails, the subscription is marked as "payment outstanding" and the customer resolves this themselves (by checking the mandate, for instance); the provider reserves the right to limit access to the account if payment continues to be missing.
7. Use of the service
The customer may use DuzMarc only to monitor domains the customer is entitled to monitor, for instance their own domains or the domains of clients with whom an agreement exists. The customer is responsible for managing user accounts within their own organisation, including assigning the right roles (administrator or member) and switching on two-step verification.
8. Availability and maintenance
The provider makes every effort to keep DuzMarc available, but does not guarantee uninterrupted operation. Planned maintenance is announced in advance where reasonably possible. The provider is not liable for damage resulting from temporary unavailability.
9. Liability
The provider is liable only for direct damage that is the immediate result of an attributable failure, up to a maximum of the amount the customer paid in subscription fees in the three months preceding the event causing the damage. Liability for indirect damage, including consequential loss and lost revenue, is excluded. DuzMarc is an aid in monitoring email authentication and offers no guarantee that every form of abuse will be prevented or detected.
10. Personal data
The processing of personal data within DuzMarc is set out in the privacy policy and, to the extent that the customer is the controller, in the data processing agreement, which automatically forms part of this agreement.
11. Intellectual property
All intellectual property rights in DuzMarc, including the software, design and documentation, rest with the provider. The customer receives only a right of use for the duration of the subscription.
12. Changes to these terms
The provider may change these terms. Important changes are announced in advance by email or through the account. In the event of material changes to the customer's disadvantage, the customer may cancel the subscription free of charge within 30 days of the announcement.
13. Governing law and disputes
These terms and the agreement are governed by Dutch law. Disputes are preferably resolved by mutual consultation. If that is not possible, the competent court in the district where the provider is established has jurisdiction, unless mandatory law provides otherwise.
